Website Terms and Conditions
For sumalytics.com, DaaFlow marketing pages and related public web content
Effective date: 30 September 2026
1. About these Terms
These Website Terms and Conditions ("Website Terms") govern access to and use of websites, landing pages, forms, product pages and other public online content operated by Sumalytics ("Sumalytics", "we", "us" or "our"), including information concerning DaaFlow, a Sumalytics product.
By accessing or using the website, you agree to these Website Terms to the extent permitted by applicable law. If you do not agree, you should not use the website.

3. Nature of website information
The website is primarily for corporate, product, commercial and informational purposes. Product descriptions, demonstrations, illustrations, screenshots, roadmap statements, case examples and other marketing material are not a guarantee that every feature is available in every deployment or customer plan.
A binding commitment concerning DaaFlow functionality, price, service levels, implementation, hosting, data residency, security requirements or support is created only by the applicable signed order form, subscription agreement, pilot agreement or other written customer contract.
4. Electronic transactions and contract formation
Where a transaction is concluded electronically, contract terms must be made available before acceptance. Users must have a reasonable opportunity to review the terms, retain or reproduce them, and correct material handling errors before completing the transaction.
Electronic acceptance, electronic records and electronic communications may be used to evidence agreements and notices to the extent recognised by Ghanaian law.
5. Permitted use
You may use the website for lawful business, research and information purposes. You must not:
attempt to gain unauthorised access to the website, DaaFlow, accounts, systems, infrastructure or data;
probe, scan, test or exploit security controls without prior written authorisation from Sumalytics;
introduce malware, malicious code or disruptive traffic;
scrape, harvest or systematically extract content or personal information in a manner that is unlawful or materially burdens the service;
misrepresent your identity, authority, organisation or relationship with Sumalytics;
use the website to infringe intellectual property, privacy, confidentiality or other legal rights; or
use Sumalytics or DaaFlow branding in a misleading way or imply an endorsement, partnership or certification that does not exist.
6. Intellectual property
Unless otherwise stated, the website, DaaFlow name and product materials, text, graphics, interface designs, documentation, software concepts, branding and other original materials are owned by or licensed to Sumalytics and are protected by applicable intellectual-property laws.
No licence is granted except the limited right to view and use the website for its intended purpose. You may not reproduce, adapt, reverse engineer, commercially exploit or distribute protected materials without permission, except where applicable law expressly permits it.
7. Third-party links and services
The website may link to third-party websites, services, cloud providers, social networks or other resources. Sumalytics does not control those third parties and is not responsible for their content, availability, privacy practices or independent acts. A link does not by itself constitute endorsement.
8. Privacy, security and marketing communications
Personal information collected through the website is handled in accordance with the Sumalytics Website Privacy Policy. Our public approach to security is described in the Sumalytics Public Security Policy.
Service-related communications may be sent where necessary to respond to your enquiry or administer a relationship. Marketing communications should be sent only where permitted by law, and recipients must be given a practical way to opt out. A person's failure to respond to an unsolicited commercial message does not constitute acceptance of a contract.
9. User submissions
If you submit an enquiry, proposal, document, feedback or other material, you represent that you have authority to provide it and that doing so does not unlawfully disclose confidential information or personal data. Do not submit passwords, payment credentials, highly sensitive personal information or customer production data through a general website contact form unless specifically requested through an approved secure channel.
10. No professional advice
General material on the website is not legal, financial, accounting, credit, investment, agronomic or other regulated professional advice. Customers remain responsible for their own decisions and for obtaining specialist advice where appropriate.
11. Availability and changes
We may maintain, change, suspend or discontinue parts of the website without guaranteeing uninterrupted availability. We may correct errors, update materials or change these Website Terms from time to time. Material changes will be published with an updated effective date.
12. Disclaimers
To the maximum extent permitted by applicable law, the public website and general marketing content are provided on an 'as available' basis. We do not warrant that the website will be uninterrupted, error-free, free of every vulnerability, or suitable for every user's purpose.
Nothing in these Website Terms excludes a statutory right, remedy, duty or liability that cannot lawfully be excluded or limited.
13. Limitation of liability
To the maximum extent permitted by Ghanaian law, Sumalytics will not be liable for indirect, incidental, special, consequential or purely economic loss arising solely from reliance on general website information, third-party links or temporary website unavailability.
Where liability cannot lawfully be excluded, liability will be limited only to the extent permitted by law. Separate customer contracts may contain different and more specific risk allocations for paid DaaFlow services.
14. Sumalytics personnel are not personal guarantors
The website, DaaFlow and related commercial services are offered by the Sumalytics legal entity, not by its founder, shareholders, directors, officers, employees or contractors in their personal capacities. No individual is to be treated as personally guaranteeing a Sumalytics obligation merely because that person communicates with a customer, demonstrates the product, signs in an authorised corporate capacity or provides support.
This clause does not exclude any personal liability that Ghanaian law imposes on an individual for that individual's own fraud, wilful misconduct, statutory breach or other liability that cannot legally be excluded, and it does not affect a separate written personal guarantee if one is expressly given.
15. Indemnity for unlawful misuse
To the extent permitted by law, a person or organisation that unlawfully misuses the website, infringes third-party rights, introduces malicious code or carries out unauthorised security activity is responsible for resulting claims, losses and reasonable costs caused by that misuse.
16. DaaFlow customer contracts
Use of the DaaFlow application is governed by separate DaaFlow Platform Terms of Service and, where applicable, an organisation's pilot agreement, order form, subscription agreement, Data Processing Agreement, service-level terms or security annex. If a signed customer agreement conflicts with these Website Terms on a DaaFlow service matter, the signed customer agreement prevails.
17. Governing law and disputes
These Website Terms are governed by the laws of the Republic of Ghana. The parties should first attempt in good faith to resolve a dispute directly. They may agree to mediation under Ghana's Alternative Dispute Resolution framework. If the dispute is not resolved and no separate agreement requires arbitration, the courts of competent jurisdiction in Ghana may hear the matter.
